เกี่ยวกับ tax refund

มีคนฝากมาถามครับว่า
กรณีที่ไปเรียนต่อที่ uk ตอนกลับแต่ตั้งใจจะกลับแบบ for good ก็เลยทำ tax refund แต่ปรากฎว่าภายหลังจากนั้นประมาณ 6 เดือนมีแผนว่าจะกลับไปเที่ยวที่ uk อีก
อย่างนี้เข้าข่ายผิดกฎหมาย uk หรือไม่อย่างไรครับ แล้วจะแก้ไขอะไรได้หรือไม่ครับ

Read between the lines.

The next time you will be going to the UK with different type of visa, will you not?

As a tourist and not a student.

When you claimed for a VAT refund, you were a student or on a work permit. If you were to return to the UK again on the same type of visa, that would definitely be against the Customs Law.

If you live outside the EU and are working or studying in the UK

If you're working or studying in the UK, you may be able to obtain a VAT refund if you're planning to leave the EU for at least 12 months.

You must:

- leave the UK for a destination outside the EU - with the goods you have bought - by the end of the third month after the month when you bought them
- stay outside the EU for at least 12 months
- show customs officials the goods, your receipts for them and a completed VAT refund document when you leave the EU

In all cases, you must be able to prove that you belong to one of the categories above by showing the customs official your passport, visa or other documents.

แสดงว่า เผอิญว่าเค้ามี visa ประเภทเดิมเหลืออยู่ แต่กรณีนี้ก็ใช้ไม่ได้ต้องไปทำ visa ท่องเที่ยวใหม่แทน

ขอรบกวนถามเพิ่มเติมหน่อยนะว่า part นี้อยู่ตรงไหนนะครับ หรือเป็นการตีความอ่ะครับAs a tourist and not a student.

"As a tourist and not a student" เป็นการตีความ

You are no longer a student when you left the UK, so the remaining visa automatically becomes invalid.

You may be allowed to leave Thailand on that visa but when you arrive at a UK airport you will be sent straight back home on a next available flight, and perhaps have to pay a heavy fine.

Do you want to take that chance?
By all means, go ahead. No one can stop you leaving Thailand on that invalid Tier 4 visa.

You can't use the remaining Tier 4 student visa to enter the UK for other purposes than for studies. Period.

30A. An entry clearance may be revoked if the Entry Clearance Officer is satisfied that:

(i) whether or not to the holder's knowledge, false representations were employed or material facts were not disclosed, either in writing or orally, for the purpose of obtaining the entry clearance; or

(ii) a change of circumstances since the entry clearance was issued has removed the basis of the holder's claim to be admitted to the United Kingdom,

Refusal of leave to enter in relation to a person in possession of an entry clearance

321. A person seeking leave to enter the United Kingdom who holds an entry clearance which was duly issued to him and is still current may be refused leave to enter only where the Immigration Officer is satisfied that:

(i) False representations were made or false documents or information were submitted (whether or not material to the application, and whether or not to the holder's knowledge), or material facts were not disclosed, in relation to the application for entry clearance; or in order to obtain documents from the Secretary of State or a third party required in support of the application.

(ii) a change of circumstances since it was issued has removed the basis of the holder's claim to admission, except where the change of circumstances amounts solely to the person becoming over age for entry in one of the categories contained in paragraphs 296-316 of these Rules since the issue of the entry clearance; or

(iii) refusal is justified on grounds of restricted return ability; on medical grounds; on grounds of criminal record; because the person seeking leave to enter is the subject of a deportation order or because exclusion would be conducive to the public good.



Moreover, you CANNOT even use the same Tier 4 visa with time remaining on it from one sponsor to enter the UK and intend to start studying on a new course with a new sponsor, hoping to apply for a visa in the UK without first applying for a new visa in Thailand.
In order to start a new course with a new sponsor, you must get a new entry clearance (Tier 4 visa) for that new sponsor.

So, to use the student visa to enter the UK for the wrong purposes you would be in all sort of trouble.

หลังจากที่เราได้ยื่นเรื่องขอคืนภาษี จะมีผลให้ Tier4 visa เราจะขาดทันทีค่ะ จะไม่สามารถใช้ได้อีกค่ะ ผิดกฏหมายและไม่น่าจะผ่านเข้า ตม. ได้ด้วยค่ะ ไปเที่ยวเฉยๆ ไม่ได้จำเป็นต้องใช้ Tier4 ฝากบอกเพื่อนให้ทำ Tourist visa ใหม่เลยค่ะ:)
