EEA Residence card ของอังกฤษ ออกจากอังกฤษมา 2 ปี จะกลับเข้าไปได้อีกไหมค่ะ

ได้ EEA Residence card ของอังกฤษ 5 ปี จะหมดอายุปี 2016 และอยู่ในอังกฤษ 1 ปี แต่ต้องออกจากอังกฤษมาเพราะแฟนได้ทุนวิจัยที่อเมริกา 2 ปี และครบสองปี ปีหน้าจะกลับเข้าไปอังกฤษอีกครั้ง จะมีปัญหาอะไรไหมค่ะ และต้องขอวีซ่าใหม่หรือเปล่าค่ะ

I take it that you are coming back to the UK with your husband, in that case when you arrive at a UK port the UK immigration wouldn't even know whether you are absent from the UK for that long period of time unless you tell them and without looking at the US visa entry and exit stamps . Even that, you will still be allowed to enter the UK with your husband without any problems.

6.5 Continuity of residence
Continuity of residence under the EEA Regulations for the family member of a
qualified person is not affected by the EEA national being absent from the UK
for periods which are under six months in any year, periods of absence on
military service or any one absence not exceeding 12 months for an important
reason such as pregnancy and childbirth, serious illness, study or vocational
training or an overseas posting.

There is nowhere in the rules which states that the RC (resident card) would become invalid, but the continuity of residence counting towards the permanent resident requirements would be broken.


5.1 Residence card holders
Residence cards also do not confer leave and are not subject to any domestic
legislation governing returning residents. It is appropriate for Border Force
officers to establish on what grounds the card was issued, these being:
• He is the family member of an EEA national who is a qualified person.
Examination should be to establish that the passenger is the rightful
holder of the document and that he is still the family member of the EEA
national who is a qualified person.
• Because he is a person who has retained the right of residence (see
paragraph 5.7.2 below). In this case there is no requirement for the EEA
national to be in the UK.
A residence card can be revoked if the holder of the card is no longer the
family member of a qualified person or an EEA national with a right of
permanent residence and has not retained the right of residence or acquired
permanent residence.

Usually Border Control Officers do ask how long the person (non-EEA) is away from the UK.

Thanks you very much for information. It's helpful, I think it's should be fine when I have to enter to UK again as long as I'm with my husband ;-)
