Need clarification on Tier 2 (General) "Cooling off Period" krub

สวัสดีครับ

เห็นว่าตอนเดือนมิถุนายนที่ผ่านมา มีการเปลี่ยน policy ของ Tier 2 visa ให้มี cooling off period ด้วย มีคำถามดังนี้ครับ
1. cooling off period จะส่งผลกับการทำ settlement เมื่อครบ 5 ปีหรือไม่
2. ถ้าผมถือ Tier 2 General สามปี แล้วจะ extend visa ไปอีกสามปีกับนายจ้างเดิม จะต้องออกนอกประเทศก่อนทุกกรณี หรือเปล่าครับ
3. ทิศทางในอนาคตของ Visa ประเภทนี้เป็นยังไงครับ เพราะช่วงนี้เปลี่ยน policy ถี่มากๆ

The new rules limiting leave in Tier 2 to a maximum of six years will apply to those who entered Tier 2 after 6 April 2011. Those who entered before then (i.e. those who entered under the rules in place on or before 5 April 2011) are not affected and may apply for further periods of temporary leave. However, the 12 month ‘cooling off’ period will apply to any Tier 2 migrant who leaves the UK and applies for entry clearance on or after 6 April 2012, regardless of when their previous leave was granted. It will also apply to those who switch out of Tier 2 while in the UK and who

The period of leave granted under Tier 2 (General) will be capped at a maximum of a total of six years. If eligible, the migrant will still be able to apply for settlement after five years (as now). Those who do not apply for or obtain settlement must leave the UK on expiry of their leave and wait 12 months before applying to return in any Tier 2 category (which will break continuity of leave for the purpose of applying for settlement). This will affect all migrants who entered Tier 2 of the points-based system after 6 April 2011.

2. I am not aware that one has to leave the UK in order to apply for a further leave to remain for the Tier 2 (general). Where did you hear about that?

ถ้าอย่างนี้ Cooling off period จะ apply กับเคสผมหรือเปล่าครับ

คือตอนนี้ถือ Tier 1 PSW ครับ ซึ่งปีหน้าน่าจะได้ convert เป็น Tier 2 General
จากระเบียบ ผมก็จะถือ Tier 2 ไปสามปีถึงปี 2016 ซึ่งจะถึงเวลาต้อง Extend อีกครั้งถ้าต้องการทำงานต่อ

อันนี้คือ Background สำหรับคำถามข้อ 2 ที่ผมได้ถามไปครับ ขอบคุณครับ

อันนี้มีประสบการณ์ตรงเลยค่ะ แต่ว่าถือ visa คนละประเภทกัน
คือปีที่แล้วไปทำงานที่อังกฤษแล้วถือ Visa T2 Intra-company transfer ที่ valid 1 ปีหลังจากนั้นตามแผนคือจะ convert ไปเป็น T2 General ซึ่งจะได้ต่ออายุอีก 3 ปี

เรื่องกลับไม่เป็นอย่างที่คิด เพราะกฎใหม่ที่ UK Boarder ออกมาตอนเดือนเมษา เพราะมันส่งผลให้เราต้องออกจากอังกฤษเป็นเวลา 1 ปีก่อนที่จะสมัคร T2 ใหม่ได้ บริษัทก็ยุ่งไปกันหมดเลยค่ะตอนนั้

แต่สำหรับกรณีของคุณ superglue คงจะไม่เป็นปัญหาค่ะเพราะว่าเปลี่ยนจาก PSW มาเป็น T2 เพื่อนเราที่เพิ่งเปลี่ยนก็ผ่านไปได้อย่างไม่มีปัญหา ยังไงก้อขอให้โชคดีละกันค่ะ

อันนี้ผมสงสัยข้ามช็อตไปเลยครับ 555 ไปถึงตอนที่ผมต้อง Extend Tier 2
ถ้า Policy เป็นแบบนี้ ผมต้องออกจากอังกฤษ 1 ปีใช่ไหมครับ

แล้วคุณ Kobe_tape ทำยังไงครับตอนนี้ ได้ทำงานต่อด้วย Visa ประเภทไหนครับ บริษัทช่วยยังไง เพราะดู Policy แล้วมันจะไม่มี Route อื่นแล้วที่จะอยู่ทำงานต่อได้ ...

ผมสามารถสมัคร settlement ได้อยู่ใช่/หมครับ
ผมสามารถกลับไปเยี่ยมบ้านที่เมืองไทย
ได้ไม่เกินกี่วันครับ จนถึงวันสมัคร ขอบคุณครับ

Question #5.

If you don't have to leave or are not forced to leave the UK (for some reasons) then you'd be entitled to apply for settlement.

There are no specific written rules on absence for settlement application, having said that 'the standard residential requirements' on Naturalisation as a British Citizen generally apply : a common knowledge, in fact.

There are seven requirements you need to meet before you apply:

You must be aged 18 or over.
You must be of sound mind.
You must intend to continue living in the UK, or to continue in Crown service, the service of an international organisation of which the UK is a member, or the service of a company or association established in the UK.
You must be able to communicate in English, Welsh or Scottish Gaelic to an acceptable degree.
You must have sufficient knowledge of life in the UK.
You must be of good character.
You must meet the residential requirements (see below).

Residential requirements

To demonstrate the residential requirements for naturalisation, you must have:

been resident in the UK for at least five years (this is known as the residential qualifying period); and
been present in the UK five years before the date of your application; and
not spent more than 450 days outside the UK during the five-year period; and
not spent more than 90 days outside the UK in the last 12 months of the five-year period; and
not been in breach of the Immigration Rules at any stage during the five-year period.

ขอบคุณมากครับ คุณ. Genf. ได้ความรู้มากเลยทีเดียวครับ
ณ ตอนนี้ผมจะได้เริ่มเก็บเอกสารไว้แต่เนิ่นๆ. แต่ก้อไม่รู้ว่า
จะมีกฏใหม่ออกมาอีกเมื่อไร. ยังไงขอบคุณอีกครั้งครับ

ตอบคุณ superglue นะคะ ปกติ Tier 2 general ได้อายุ 3 ปี หลังจากนั้นจะขอ extend เป็น 5 ปีได้นะคะ ถ้าจำไม่ผิด แต่หลังจาก 5 ปีก้อคงต้องออกจากประเทศไป 1 ปีล่ะค่ะ ไม่แน่เหมือนกันหลังจากนั้น UK boarder อาจจะเปลี่ยนกฎอีกก้อได้

สำหรับเราเหรอคะ ก้อต้องออกจากประเทศอังกฤษอย่างไม่มีทางเลือกล่ะค่ะ เค้าไม่ได้ไปปล่อยช่องให้เราเลย แต่จิงๆก็ถือเป็นโอกาสดีเพราะได้ย้ายมาที่อเมริกาแทน มีความสุขดี๊ด๊าเลยล่ะค่ะ :)

ยังไงก้อขอให้ทุกคนโชคดีกับการทำวีซ่านะคะ เกิดเป็นคนไทยก้อลำบากนิดนึงล่ะค่ะ
